About the regulations of the societas quaestus - referable to the societas universorum quae ex quaestu veniunt and to the societas unius alicuius negotiationis and unius rei - the interpretative efforts of the Roman jurists were given profusely since the end of the republican age. The scientific monograph puts itself on the traces of identifying the notion of quaestus (gain) with particular reference to the inclusion within it of the so-called remuneration gifts. Furthermore it reconstructs the jurisprudential debate that aroses around the question of whether the socii - in the determination of the shares - had to respect a proportion with the contributions and in this sense with an attempt to explain the existing contrast between a passage from the Digest and one of the Iustiniani Institutiones. Moreover always with specific reference to the societas quaestus the monograph investigates the setting-up of the intempestiva renuntiatio supporting its origin out of the contrast between Proculiani and Sabiniani so far postulated in doctrine. Il contributo analizza il reato di intermediazione illecita e sfruttamento lavorativo, offrendo un’analisi comparata con il sistema repressivo tedesco. Lo studio si sofferma, in particolare, sui limiti di legittimazione del diritto penale nella punizione dei fatti di “caporalato”, nel tentativo di scongiurare che l’intervento repressivo nelle dinamiche economiche e contrattuali, di natura sinallagmatica, possa assumere una portata tale da porsi in contrasto con il canone della sussidiarietà. Settore IUS/17 - Diritto PenaleThe paper analyses the offence of unlawful work intermediation and exploitation offering a comparative analysis with the German punitive system. The study focuses in particular on the limits of legitimacy of criminal law in the punishment of gangmaster acts in the attempt to avoid that the punitive intervention in economic and contractual dynamics of a mutual nature could be so intrusive to be in contrast with the principle of subsidiarity. To this end the author suggests an interpretative perspective that centres the penal disvalue of the offence under article 603-bis of the criminal code on the harm to fundamental workers’ rights – as linked to articles 4 35 and 36 of the Italian Constitutions – which work as a limit to entrepreneurial freedom. To be sure the indexes of exploitation listed by the criminalising norm seem to echo those fundamental human rights attributed to a person as a worker: those very same rights that – when harmed in their minimal and therefore intangible dimension – legitimise the intervention of the ius terribile. The article also stresses the protection of the job market: in this sense the offence – even if situated within the Kernstrafrecht – represents a new paradigm of the institutional response within the framework of the contemporary relationships between law and economics.

Observaciones sobre una reflexión heterodoxa en los Comentarii de Juan Luis Vives a la Ciudad de Dios de San Agustín

The Patres ecclesiae?s works were a frequent topic of discussion at the time in which many humanists stood against the decadent medieval scholastics. That Juan Luis Vives was part of this tradition is demonstrated in his commentaries on Saint Augustine works. Despite its pedagogical function, the scholia of the Valencian author became quite subjective. In this sense, his ecdotic work or, specially, his «criticisms and censures» can be mentioned. Here, Vives strongly disapproves of the intense political and intellectual turmoil of his epoch. Thus, this article is aimed at describing those annotations in which Vives adopts such an Erasmist point of view to comment Augustine?s De Civitate Dei.…

This article describes the main results of an ethnographic study on citizen participation carried out in the context of the development of the Urban Initiative (2007-2015): Cuenca-Barrio de San Antón.
